Furthermore, at the time of making the membership request, the Subscriber acknowledges that he or she has read the Eurostar Privacy Policy that appears on www.eurostar.com.

6. SPECIAL OFFERS RELATED TO THE SUBSCRIPTION PASSES

When applying for, or renewing a subscription pass through www.eurostar.com, a customer may potentially benefit from two different kinds of special offers:

  1. public offers available to an open audience
  2. dedicated offers only available for a specific company

Both types of offers require a specific code, distributed by Eurostar, to be entered.

Eurostar reserves the right to grant the above-mentioned special offers on a case-by-case basis without any obligations for Eurostar.

Under no circumstances will it be possible to accumulate different types of sp on a single subscription over a single period.

7. SUBSCRIPTION PROCEDURE

The subscription pass can be purchased on www.eurorstar.com or via the Eurostar Customer Service Center (as mentioned in article 15 below).

The subscription pass can be purchased by a secure online payment or by a wire transfer.

In the latter two cases, once Eurostar has confirmed the payment, a subscription/renewal confirmation email will be sent to the Subscriber.

As soon as the payment has been registered by Eurostar, and insofar as the Subscriber is not already a member of the Club Eurostar Programme, Eurostar will send the Subscriber an email confirming membership of Club Eurostar with his or her Club Eurostar Member Number. The Subscriber will then be able to access his or her digital card and all of the information about the subscription, upcoming journeys, and the advantages, directly through his or her customer account on www.eurostar.com.

8. START DATE AND DURATION OF THE SUBSCRIPTION

At the time of the subscription pass application, the Subscriber shall indicate the desired start date for the chosen subscription (no later than one month after registration), as well as the requested duration.

If a secure payment is made when applying online, the subscription pass can be effective within 24 hours of registering the payment, if this is requested by the Subscriber.

If the payment is made by bank transfer following the online request, the subscription pass will in any event only be effective after a period of 24 hours following confirmation of the payment by Eurostar.

If the payment is received after the desired start date, the initial subscription pass will be cancelled, and the subscriber will need to call the Eurostar Contact Center (as described in Article 15) in order to communicate the new desired start date of his or her new subscription pass. In all cases, the subscription pass will be effective at the earliest 24 hours after an agent has validated the payment of the new subscription pass.

If the payment is validated before the desired start date, the subscription pass will be activated on the desired start date.

One month before the expiry date of this subscription pass, the Subscriber will be able to renew the subscription pass online in the customer account on www.eurostar.com.

The Subscriber will be able to choose the type of subscription desired and its new start date.

9. ORDERING TICKETS WITH A SUBSCRIPTION AND ON-BOARD INSPECTION

To benefit from the preferential fare corresponding to his or her subscription, it is essential that the Subscriber, at the time of booking Eurostar Continental Route tickets, mentions that he or she has a subscription pass, regardless of the chosen sales channel (Internet, telephone, call centre, agency, etc.). The Subscriber is not authorised to benefit from the preferential fare associated with the subscription when booking tickets for travel after the date on which the subscription pass ends or before the subscription starts.

Without prejudice to the Eurostar Services Terms and Conditions of Carriage accepted when booking a ticket, a Subscriber may be required to present a form of valid ID** during ticket inspection prior to boarding the train, at the gate and/or during the journey.

If the Subscriber cannot prove by a form of valid ID** that he or she holds a valid subscription, or if the passenger presents a booking that corresponds to a subscription of which he or she is not the holder, the Train Manager will adjust the price on board, in other words, request payment of the reference fare in Premium, Comfort or Standard*, with a €25 surcharge.

* The reference fare is the highest price in Premium, Comfort and Standard areas.

** “Valid ID” refers to a valid form of identification that can be used to verify the identity of an individual. Acceptable forms of ID include, but are not limited to, passport, national identity card, driving licence, student ID, etc.

11. PROCESSING OF PERSONAL DATA

The personal data provided by the Subscriber will be used, processed, and stored by Eurostar in accordance with Eurostar’s Privacy Notice, which is available on the eurostar.com website. To this end, Eurostar, as data controller, will fulfil all of its obligations under the GDPR with regard to the protection of personal data.

Eurostar thereby undertakes to preserve the integrity and confidentiality of your personal data and to put in place the technical and organisational measures necessary to protect your personal data in accordance with the applicable legislation against accidental or unauthorised destruction, accidental loss as well as modification, access, and any other unauthorised personal data processing.

The Subscriber has a right of access, rectification, portability, erasure of his or her personal data as well as a right to oppose and limit processing. These rights may be exercised in accordance with the Eurostar’s Privacy Notice available on the eurostar.com website.

12. REVIEW OF TERMS AND CONDITIONS AND EXCLUSION

Subject to the next paragraph, Eurostar reserves the right to amend these Terms and Conditions at any time, without notice, except as provided for in the next paragraph.

Eurostar may change, cancel, or replace one or more subscriptions (including but not limited to any change in the conditions and advantages set out in article 10), on reasonable notice to the Subscribers, as appropriate. The Subscriber will then have the option of cancelling his or her subscription free of charge, by sending a registered letter to THI Factory – Customer Service Center - 4 Place Marcel Broodthaers, 1060 Brussels, Belgium, at least 15 days before the said changes come into effect (i.e. the date indicated on the notice sent by Eurostar). Eurostar will refund the Subscriber the price of the subscription pro rata to its remaining term from the cancellation date.

In the absence of such cancellation, the Subscriber will be deemed to have accepted the said changes.

Furthermore, Eurostar reserves the right to end the subscription of any Subscriber who does not comply with these Terms and Conditions, the Eurostar Continental Route Services Terms & Conditions of Carriage, or any other conditions of Eurostar which he or she would have accepted, or if he or she has made abusive or fraudulent use of a Frequent Pass or a Premium Pass. Cancellation leads to the immediate loss of all the Advantages and Services associated with the subscription without any compensation or indemnity. No new membership will be authorised.

Under no circumstances will the subscription price quoted in article 5 be reviewed during the subscription.

13. LIMITATION OF LIABILITY

The Subscriber acknowledges and explicitly agrees that the only obligation incumbent on Eurostar in the framework of the subscriptions consists of supplying the Subscriber with a preferential fare in accordance with what is set out in article 10 above, for the duration of the chosen subscription, under the terms and conditions stipulated by it.

14. ASSIGNMENT OF RIGHTS AND OBLIGATIONS

A subscription pass is strictly personal and nominative. Under no circumstances may the Subscriber assign the rights accruing from his or her subscription pass to third parties. Other than the cooling-off period of 14 calendar days stipulated by Directive 97/7/CE concerning the protection of consumers in matters of remote contracts or in case of use of the subscription pass, the subscription pass is not refundable.

In application of Directive 97/7/EC on the protection of consumers in respect of distance contracts, the Subscriber is entitled to obtain a refund of his or her subscription pass within 14 calendar days from the Pass subscription date. The Subscriber may be entitled to a full refund if his or her subscription pass has not been used. If he or she has travelled with his or her subscription pass, Eurostar reserves the right to deduct from the total price of the subscription pass the difference between the reduced price of the transport ticket resulting from the use of the Pass subscription and the full price of the corresponding transport ticket.
