Eurostar Plus Points Terms and Conditions
 
Introduction
 
This sets out the Terms and Conditions of Your Membership to the Eurostar™ Plus Points programme and sets out Your rights as a Member.  You should read it carefully. Once You become a Member and are issued with a Membership Number, You will be bound by these Terms and Conditions. The Terms and Conditions contain some exclusions and limitations of liability and You should note, in addition, that the Terms and Conditions provide that:
 
A.     Eurostar reserves the right to amend these Terms and Conditions at any time during Your Membership.  This means that Eurostar may, for instance, at any time:
 
         *          increase the number of Points required to attain e-Vouchers or add to or vary the circumstances in which e-Vouchers can be used;
         *          change the amount of the e-Vouchers awarded or the criteria to receive an e-Voucher;    
         *          change the procedure for collecting Points or redeeming e-Vouchers; or
         *          amend or change any other part of the Eurostar Plus Points programme.
 
Wherever possible, Eurostar will make these changes where we are required to do so by circumstances outside our control, or to provide You with better benefits under the Eurostar Plus Points programme but we reserve the right to do so otherwise.  We will endeavour to give You reasonable notice of such changes whenever possible and You may cancel Your Membership if You do not consent to them.
 
B.      The number of Points You can earn at any one time is limited and You will not be able to obtain e-Vouchers on Points earned above the set thresholds as published by Eurostar on Eurostar.com from time to time.
 
C.     In order to obtain Points, travel must be booked via Eurostar.com and Your Membership Number must be quoted at the time of booking.  You may not make retrospective claims once the booking has been made.  Points will remain as Pending Points until You travel on Eurostar train services.
 
D.     At the time You apply to open an Account, You will be asked to elect which currency You want the e-Vouchers issued in; either Pounds Sterling or Euros.  Once You elect to use a particular currency You will not be able to change to the other without closing Your Account and opening a new Account. You will lose Your Points when You close Your Account.
 
E.      Eurostar may terminate the Eurostar Plus Points programme or Your Account immediately by notice to You in writing.
 
F.      Eurostar reserves the right to refuse Membership to the Eurostar Plus Points programme to any person for any reason in Eurostar’s absolute discretion.
 
 
1.                 Definitions
 
In these Terms and Conditions we have given some words a special meaning.  These words have this meaning whenever they start with a capital letter and the meanings we have given to them are set out below:

Definitions
 
“Account”
means Your online Eurostar Plus Points account;
“Active Membership”
means the Membership of a Member on whose Account at least one Eligible Journey has been made in the preceeding eighteen months;
“Active Points”
means Pending Points credited in accordance with clause 7.1;
“Affiliate”
means a friend or family member, permanently residing in France, Belgium or the United Kingdom, using Your Membership Number to accumulate Points on Your Account
“Eligible Journey”
means a journey travelled on a Eurostar train service by a Member or an Affiliate from which Active Points were credited to Your Account;
“Eurostar”
means the Société Nationale des Chemins de Fer Français, the Société Nationale des Chemins de Fer Belges, Eurostar International Limited and Eurostar Group Limited which together provide the international passenger rail service and the Eurostar Plus Points programme;
“Eurostar Plus Points”
means the Eurostar Plus Points loyalty programme which is governed by these Terms and Conditions;
“e-Voucher”
means the electronic vouchers issued by Us when Your Active Points are redeemed;
“Member” and “Membership”
means respectively a member of or a membership to the Eurostar Plus Points programme;
“Membership Number”
means the membership number issued to You at the time You became a Member;
“Partner”
means a provider of services to Eurostar;
“Pending Points”
means Points credited to Your Account in return for booking travel on Eurostar train services which have not yet become Active Points in accordance with clause 7.1;
“Points”
means either Active Points and/or Pending Points credited to Your Account in return for activity with Eurostar as the context dictates;
“Terms and Conditions”
means these terms and conditions (including the Eurostar e-Voucher terms and conditions of use) as amended or varied from time to time;
“Us”, “We”
means Eurostar; and
“You”, “Your”
means a Member of Eurostar Plus Points.
 
2.               Membership Eligibility
 
2.1             Membership is open to individuals aged 16 years or over who permanently reside in France, Belgium or the United Kingdom only.
 
2.2             Application for Membership may only be made online via the Eurostar.com site and must be made in Your full legal name.
 
2.3             You may only have one Account at any one time and You must not be a current member of the Eurostar Frequent Traveller programme.
 
2.4             Membership is for individuals only, corporate and legal entities may not become Members.
 
2.5             You must notify Us of any changes to Your personal details (for example Your name, contact details and email address) as soon as possible by updating Your personal details on Your Account on Eurostar.com.
 
2.6             To qualify for Active Membership, You must have travelled on an Eligible Journey at least once following the creation of Your Account.
 
2.7             You must maintain an Active Membership during Your period of Membership.  If You do not, then Your Membership will expire without further notification to You and any Points credited to Your Account will expire and Your Account will be closed.  You will no longer be entitled to accumulate Points or receive e-Vouchers in respect of the Points.
 

 

3.               General
 
3.1             You will be solely responsible for any and all costs, taxes, charges, claims or liabilities of any nature arising from the provision of e-Vouchers or any other facilities, rewards or arrangements which are provided or made available to You as a result of Your Membership.
 
3.2             By creating Your Account and by quoting Your Membership Number each time You book a Eurostar train journey on the Eurostar.com site, You confirm that You agree that:
 
            (i)         You have read, understood and You accept these Terms and Conditions (as may be amended by Us from time to time);
 
            (ii)        You fulfil the criteria stated in Clause 2 for Membership; and
             
            (iv)       You consent to Eurostar creating, maintaining and updating data that is personal to You.
 
3.3             Your consent to these Terms and Conditions shall be deemed to continue until termination of Your Membership, howsoever it occurs.
 
3.4             If You wish to terminate Your Membership, You must do so through Your Account on the Eurostar.com site .  Any Points accumulated by You at that date will be cancelled on termination of your Membership.
 
3.5             Eurostar may, at any time, in accordance with these Terms and Conditions, revoke Your Membership with or without notice to You.
 
3.6             In order to obtain Points, travel must be booked online via the Eurostar.com site and Your Membership Number must be quoted at the time of booking.  You cannot make retrospective claims once a booking has been made.
 
3.7             Points have a redemption value of 0.001 pence each.  Points are not refundable or exchangeable for any form of cash or credit alternative.
 
3.8             You will not be issued with a membership card during the term of Your Membership.  Membership does not entitle Members or their Affiliates access to fast track check-in or any business lounges.
 
 
4.               Amendments to the Eurostar Plus Points Programme
 
4.1             Eurostar reserves the right to change or alter any part of the Eurostar Plus Points programme including, without limitation, Point collection and e-Voucher redemption arrangements.  Any such changes will normally only be made where we are required to make them through circumstances beyond our control, or in order to provide You with a better  Eurostar Plus Points programme, but we reserve the right to do so otherwise. 
 
4.2             Any changes will be notified to You by e-mail to the address last notified to Us by You through Your Account.  It is Your responsibility to ensure that You inform Eurostar in the event that Your details change in accordance with clause 2.5.  Wherever possible, we shall try to give You reasonable notice of any changes.  However, sometimes it may be necessary to make changes with immediate effect.  In those cases, we will notify You as soon as possible after the changes have taken effect.
 
4.3             In addition to Your acceptance of these Terms and Conditions in accordance with Clause 3.2 You will be deemed to have agreed to any changes to the Eurostar Plus Points programme made by Us if, after we have sent You notice of such changes, You do not terminate Your Membership as set out in Clause 3.4.
 
4.4             We reserve the right to cancel the Eurostar Plus Points programme or any part of it (including any individual’s Membership) at any time with or without notice to You. However, We will endeavour to give You as much notice of the termination of the Eurostar Plus Points programme as possible during which time You may be entitled to continue to earn Points and receive e-Vouchers.  Following the termination of the Eurostar Plus Points programme, You will not be able to earn Points or receive e-Vouchers, or obtain any other service, facility or arrangement offered as part of the Eurostar Plus Points programme. In the unlikely event that Eurostar is required to terminate the Eurostar Plus Points programme with immediate effect, You may not be entitled to earn Points or receive any e-Vouchers from the date of termination.
 
4.5             Eurostar shall not be liable for any loss, costs or damages whatsoever, whether direct or indirect, arising directly or indirectly from any change to or termination of Your Membership of the Eurostar Plus Points programme.
 
4.6             Eurostar will not be liable for any loss or damage, whether direct or indirect, arising from the provision or non-provision, termination or change, whether in whole or part, of any such services, e-Vouchers, facilities or arrangements made available to You by a third party as part of the Eurostar Plus Points programme.
 

 

5.                 Data
 
5.1             Eurostar may create, maintain and update data which is personal to You and which may include, without limitation:
 
(i)                  Membership data (for example: title, name, e-mail address etc);
 
(ii)                travel data (for example: journeys taken, Points accumulated, class of travel taken and e-Vouchers issued and used);
 
(iii)                information about Your Affiliates; and
 
            (iii)       contact data in relation to correspondence between You and Us(for example: enquiries regarding Membership etc).
 
5.2             The data will be maintained and updated for the purpose of providing relevant information and services to You.
 
5.3             You consent to Your data stored by Eurostar (whether personal or otherwise) being supplied to Partners or employees or agents of Eurostar or Partners where it is necessary, in Eurostar’s absolute discretion, for the running of the Eurostar Plus Points programme or the provision to You of e-Vouchers.  We also reserve the right to use Your e-mail address to notify You of any matters which we feel may be of interest to You.
 
5.4             Should You wish to update, correct or amend Your data, You must do so through the Your Account section of the Eurostar.com site.
 
5.5             We will comply with the EU Data Protection Directive 95/46/EC as implemented in by Data Protection Act 1998 and the Data Protection Act Principles.
 

 

6.               Transferability and Misuse
 
6.1             Any e-Vouchers awarded to You under the Eurostar Plus Points programme are transferable (subject to the terms of the e-Voucher); however at no time may Points, e-Vouchers or a Member’s account be purchased by or sold to another person.  Eurostar may terminate Your Membership immediately if You and/or an Affiliate purchases or sells Points, e-Vouchers or a Member’s account.  Any such Points, e-Vouchers or Member’s account purchased or sold will be void and You will be liable for damages, court proceedings and any related costs.
 
6.2             You must not publish or otherwise distribute Your Membership Number for the purpose of gaining additional Points.  Eurostar may monitor Your Account usage (including Points earned by You and/or Your Affiliates) and We may terminate Your Account immediately if any suspicious or fraudulent behaviour is detected (including, for the avoidance of any doubt, suspicious of fraudulent behaviour by Your Affiliates).  Any such Points or e-Vouchers issued to Your Account will be void.
 
6.3             Fraud, abuse of the Eurostar Plus Points programme or other unacceptable behaviour by You (including abuse of Eurostar staff) may result in appropriate administrative and/or legal action by Eurostar, including the forfeiture of all accrued Points and e-Vouchers and termination of Your Membership.
 
6.4             Any purported purchase, sale, transfer, unauthorised use or redemption of Points issued or e-Vouchers issued or any other use of Points contrary to these Terms and Conditions will constitute a fundamental breach by the Member of these Terms and Conditions and will entitle Eurostar to terminate Your Membership with immediate effect, cancel any outstanding Points or e-Vouchers and take any and all appropriate legal action as required.
 

 

7.               Earning Points on Eurostar
 
7.1             Subject to any thresholds published on the Eurostar.com site You can earn Points whenever You or Your Affiliates book travel on Eurostar train services online via the Eurostar.com site.  Points will be credited to Your Account as Pending Points until: -
 
(i)                  if the ticket purchased for the Eurostar journey is exchangeable or refundable – the date You or Your Affiliate actually travels; or
 
(ii)                if the ticket purchased for the Eurostar journey is non-exchangeable or non-refundable the date of travel shown on the ticket has passed.
 
Following the occurrence of (i) or (ii) the Points will be credited to Your Account as Active Points.
 
7.2             Points will be awarded according to the price of the ticket purchased.  We will publish the details of the number of Points awarded against the price of the ticket purchased on the Eurostar.com site as amended from time to time.
 
7.3             The number of Points You can earn at any one time is limited and You will not be able to obtain e-Vouchers on Points earned above the set thresholds published by Eurostar on Eurostar.com from time to time.
 
7.4             Pending Points will expire twelve (12) months from the time that they are credited to Your Account and Active Points expire after a period of eighteen (18) months from the time that they are credited to Your Account.  Upon expiration, Points will be removed from Your Account and will no longer be able to be used to earn e-Vouchers.
 
7.5             Points cannot be awarded for Eurostar travel where bookings have been made as part of a package via eurostar.com (i.e include a combination of Eurostar and hotel and/or Car Hire).
 
 
8.               e-Vouchers
 
8.1             e-Vouchers will be automatically issued to Your e-mail address when the Active Points in Your Account reach the number published on the Eurostar.com site (as amended from time to time).  These Points cannot be re-credited to Your Account following an e-Voucher being issued.
 
8.2             e-Vouchers can only be used when booking travel via the Eurostar.com site and are subject to the e-Voucher terms and conditions as issued by Eurostar from time to time.  The e-Voucher terms and conditions as at 1 November 2009 are included in Schedule 1.
                                                                                                                     
8.3             e-Vouchers may not be used in conjunction with any other reward, promotion, coupon, discount, e-Vouchers issued in a different currency, or any special offer and are void where and to the extent prohibited by law.  e-Vouchers may not be used to purchase tickets issued in a currency different to the currency the e-Voucher was issued in.  We reserve the right to limit the fare types that can be booked with e-Vouchers and bookings of Eurostar journeys with e-Vouchers are subject to availability at the time of booking.  Cash payments (via debit or credit cards) may be combined with e-Vouchers as part payment for travel unless otherwise specified by Eurostar. If the value of the e-Vouchers exceeds the value of the ticket for the Eurostar journey, You will not be entitled to any reimbursement for the difference in price.
 
8.4             You will not earn Points on Eurostar journeys undertaken by You or an Affiliate for the portion of the ticket price purchased using an e-Voucher.
 
8.5             e-Vouchers are not exchangeable or redeemable for any form of cash or credit alternative.
 
8.6             e-Vouchers can be applied towards travel on train services involving a Eurostar journey booked on the Eurostar.com site only and do not include government inspection fees, departure tax, customs fees, immigration fees, customer user fees, fuel surcharges, agricultural inspection fees or other incidental fees or taxes charged by any person or relevant authority or body.  These fees will be Your responsibility.  If it is required to do so, Eurostar will provide any relevant fiscal authorities with full details of any persons in receipt of the Points and e-Vouchers.  Any liabilities that arise as a result of the submissions of these details or from a direct notification by a Member, shall be the personal liability of the Member concerned and shall not be borne or paid by Eurostar.
 
8.7             It is Your responsibility to ensure that You have the correct visas and travel documents as required and that they are valid for each country visited and that You comply with all security requirements.  You may be denied boarding if Your documents are not in order.  Eurostar shall not be liable for any consequences arising from Your failure to have the correct documentation or to comply with security requirements.
 
8.8             The number of Points earned will differ according to Your choice of currency at the time Your Account was created and the currency tickets are purchased in by You and Your Affiliates. 
 
 
9.               e-Voucher Travel on Eurostar
 
9.1             In the event of cancellation by You or Your Affiliate of a ticket fully or partly paid for with e-Vouchers, if the ticket is refundable Your Account will be re-credited with the amount of e-Vouchers used to purchase such ticket.
 
9.2             The Eurostar International Limited Conditions of Carriage and the fare terms apply.  Copies of the Conditions of Carriage are available on the Eurostar.com site.

10.             Limitations on Eurostar’s Liability
 
10.1         Limitations on Eurostar’s liability appear in particular at clauses 4.5, 4.6, 8.6 8.7, 10.2, 10.3, 11.1 and 11.4 and as set out below.
 
10.2         Eurostar’s maximum liability in relation to the Eurostar Plus Points programme whether for negligence, breach of contract or any other matter shall be limited to issuing You with either (at Our discretion) Points or Eurostar vouchers equivalent to those Points which have been either wrongly deducted or which should have been credited to You but were not.  Your Affiliates are third parties for the purpose of the Contracts (Rights of Third Parties) Act 1999 and any similar law in France or Belgium if You agreement with Eurostar is governed by French or Belgian law.  Eurostar does not seek to exclude liability for death or personal injury caused by its negligence.
 
10.3         Eurostar has no liability for the acts or omissions of third parties.
 
10.4         While every effort has been made to ensure all the information on the Eurostar.com site (including information about Your Account) and e-Vouchers is correct, Eurostar is not responsible for any errors, whether printing ortypographic errors or otherwise, or any consequences thereof.
 
10.5         The Eurostar.com site may be unavailable from time to time due to mechanical, technical, software, hardware or third-party vendor failures, updating or construction.  We cannot predict or control when such downtime may occur and cannot control the duration of such downtime.  Eurostar cannot be held responsible for the unavailability of the Eurostar.com site. You will not be able to credit Points for bookings not made on the Eurostar.com site.

 

11.             Miscellaneous
 
11.1         If, by reason of a local law or regulatory prohibition or restriction, Eurostar is unable to make the Eurostar Plus Points programme or any part thereof available in certain countries or to certain individuals Eurostar will not be liable for any such unavailability.
 
11.2         In the case of duplication of Membership, all Memberships and all duplicated Points and unused e-Vouchers will be cancelled.
 
11.3         Notices sent to You shall be deemed to have been received by You if sent to Your e-mail address as held by Eurostar. 
 
11.4         Eurostar will not be responsible for late, lost or mis-directed e-mails.
 
11.5         In the event of Your death, Your Membership will be terminated automatically and all accumulated Points and unused e-Vouchers will be cancelled.
 
11.6         Any changes to the Terms and Conditions that have been made so as to comply with local laws and regulations shall prevail.
 
11.7         If at any time one or more of these Terms and Conditions becomes invalid, illegal or unenforceable in respect of any applicable law, the validity, legality and enforceability of the remaining Terms and Conditions shall not be in any way affected or impaired thereby.
 
11.8         These Terms and Conditions do not constitute or create a members or proprietary club. 
 
11.9         If Your country of residence as notified by You to Eurostar at the time You access the Eurostar.com site to create Your Account is in France or Belgium, these Terms and Conditions are governed by the law of that country.  In the event of any dispute between You and Eurostar, You agree to submit to the exclusive jurisdiction of the courts of that country.  If Your country of residence as notified by You to Eurostar at the time You access the Eurostar.com site to create Your Account is in the United Kingdom, these Terms and Conditions are governed by English law and in the event of any dispute between You and Eurostar, You agree to submit to the exclusive jurisdiction of the English courts.
 
11.10     These Terms and Conditions are correct at the date of publication and prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials.

 

Schedule 1
 
Eurostar™ e-Voucher – terms and conditions of use
 
This Eurostar e-Voucher may only be used in accordance with these terms and conditions.
 
It may be used as full or part payment against the cost of any ticket involving a Eurostar journey purchased from the Eurostar.com site and is valid for a period of one (1) year from its date of issue.
 
This Eurostar e-Voucher is redeemable against travel on train services purchased from the Eurostar.com site involving a Eurostar journey only and is not redeemable against hotel bookings or other destination services (including, but not limited to, car hire, travel insurance, attraction passes and sightseeing tours).
 
This Eurostar e-Voucher may only be used to buy tickets in the currency in which it is issued.
 
This Eurostar e-Voucher may only be used in conjunction with other Eurostar e-Vouchers issued in the same currency.
 
This Eurostar e-Voucher is not refundable or exchangeable for any form of cash or credit alternative. 
 
Whilst this Eurostar e-Voucher is transferable it may not be sold.  Eurostar International Limited reserves the right to void any Eurostar e-Voucher it reasonably believes have been available for sale or sold, obtained though fraudulent activity or obtained though a breach of the terms and conditions of the Eurostar Plus Points programme.
 
Eurostar International Limited shall not be liable to any person in the event of a Eurostar e-Voucher being stolen, damaged, lost or made void pursuant to the previous condition regardless of whether it has been used.
 
Conditions of Carriage and fare terms apply for travel on Eurostar and all other train services. 
 
Tickets are subject to availability, which may be limited.
