EUROSTAR™ FREQUENT TRAVELLER MEMBERSHIP AGREEMENT
TERMS AND CONDITIONS

Introduction

This sets out the Terms and Conditions of Your Membership of Eurostar™ Frequent Traveller and sets out Your rights as a Member. You should read it carefully. Once You give your membership number for the first time, You will be bound by these Terms and Conditions. The Terms and Conditions contain some exclusions and limitations of liability and You should note, in addition, that the Terms and Conditions provide that:

A. Eurostar reserves the right to amend these Terms and Conditions at any time during Your Membership. This means that Eurostar may, for instance, at any time:

* increase the number of Points required to attain a particular Reward or add to or vary the number of days when any particular Reward will not be available;

* change the benefits received for holding any particular Tier of Membership;

* change the requirements needed to reach any particular Tier of Membership;

* change the procedure for collecting Points or redeeming Rewards;

* withdraw the ability to collect Points or redeem Rewards from Partners;

* amend or change any other part of Eurostar™ Frequent Traveller.

Wherever possible, Eurostar will make these changes where we are required to do so by circumstances outside our control, or to provide You with better benefits or Rewards, but we reserve the right to do so otherwise. We will give You reasonable notice of such changes whenever possible and You may cancel Your Membership if You do not consent to them.

B. The number of Rewards available at any one time may be limited and You may not be able to obtain certain types of Rewards at certain times.

C. Eurostar may terminate Eurostar™ Frequent Traveller by writing to You six months before such termination.

D. Eurostar reserves the right to refuse Membership of Eurostar™ Frequent Traveller to any person.

1. Definitions

In these Terms and Conditions we have given some words a special meaning. These words have this meaning whenever they start with a capital letter and the meanings we have given to them are set out below:

“Active Membership”

means the Membership of a Member who has: (i) travelled on the necessary Qualifying Fare to achieve Active Membership; and (ii) purchased and travelled on one Eurostar journey (single or return) in one year to maintain Active Membership;

Application Form

means the Eurostar™ Frequent Traveller form which You have completed in order to become a Member;

“Card”

means the Eurostar™ Frequent Traveller Membership Card;

“Eurostar”

means Eurostar International Limited;

“Eurostar carte blanche”

means the upper tier of membership for the members of Eurostar™ Frequent Traveller;

“Eurostar

 carte classique”

means the lower tier of membership for the members of Eurostar™ Frequent Traveller;

“Eurostar™ Frequent Traveller”

meansthis programme for Eurostar frequent travellers;

“Eurostar™ Frequent Traveller service centre”

means the call centre and administrative centre for Eurostar™ Frequent Traveller;

“Eurostar Plus Points”

means a separate rewards programme operated by Eurostar to which different terms and conditions apply;

 

Inactive Membership”

means the Membership of a Member who has not purchased and travelled on any Eurostar journeys in the last year to maintain Active Membership;

“Member” and “Membership”

means respectively a member or membership of Eurostar™ Frequent Traveller;

“Member Guide”

means the current version of the electronic handbook produced from time to  time by Eurostar for Members;

“Partner”

means those organisations and companies which provide services, benefits, facilities or arrangements to Members by reason of their Membership;

“Points”

means the Points credited to Your Membership in return for activity with Eurostar or Partners;

“Qualifying Fares”

means Eurostar fares that entitle You to join Eurostar™ Frequent Traveller which are available at www.eurostar.com and are updated from time to time;

“Reward”

means a ticket issued by or benefit received from Eurostar or a Partner upon redemption by You of the whole or an appropriate part of Your Points;

“Tiers”

means the level for those achieving the minimum requirement to join the Eurostar™ carte classique lower membership level or the Eurostar™ carte blanche upper membership level;

“Us”, “We”

means Eurostar;

“You”

means a Member of Eurostar™ Frequent Traveller.


2. Membership Eligibility

2.1 Membership is open to individuals aged 18 years or over with an address for correspondence inFrance,Belgiumor theUnited Kingdomonly.

2.2 Application for Membership must be made in Your full legal name.

2.3 You may only have one Membership at any one time and You must not be a current member of the Eurostar™ Plus Points loyalty programme.

2.4 Corporate and legal entities may not become Members.

2.5 Any change to Your name or address must be notified to the Eurostar™ Frequent Traveller service centre in writing. We may require proof if You change Your name.

2.6 To qualify for Membership, You must have travelled on the Qualifying Fare as detailed in the Application Form or on www.eurostar.com.

2.7 To achieve Active Membership you must make at least one Eurostar journey at a Qualifying Fare necessary to qualify for Membership. To maintain Your Active Membership You must purchase and travel on at least one Eurostar single or return journey in each year. If You do not, then Your Active Membership will expire without further notification to You and You will be considered to be an Inactive Member.

2.8 As an Inactive Member you will have a period of one year from the date of expiry of Your Membership to redeem any remaining Points before they expire and after this period has elapsed You will no longer be entitled to redeem these Points or claim any Reward in respect of the Points. As an Inactive Member if You purchase and travel on one Eurostar journey within the period of one year Your Membership will revert to being an Active Membership. You must quote your membership number at the time of purchase in order to trigger Active Membership.

2.9 If you remain an Inactive Member for a continuous period of one (1) year or more from the date of expiry of Your Membership We may cancel your Membership at which time your Card will become invalid and you will no longer be entitled to earn or redeem Points or claim any Reward.

3. Cards

3.1 All Cards remain the property of Eurostar. The Eurostar™ carte blanche Card is only valid for use until the expiry date indicated on it. The Eurostar™ carte classique Card is valid for use while the Member has Active Membership only. Any use or attempted use of either Card beyond its validity will be deemed a breach of these terms and conditions. Eurostar may request the immediate return of the relevant Card in these circumstances.

3.2 The Cards contain a magnetic strip which can be used to obtain tickets from the self service ticket machines. Eurostar™ carte blanche holders can also use it to access the Business Premier lounges. Eurostar reserves the right to ask for photographic identification upon entry to the lounge.

3.3 The individual whose name appears on the Card is the only person who may use the Card for any purpose whatsoever. You must not lend or give Your Card to any other person. Eurostar reserves the right to exercise routine and/or random checks requiring Members to provide proof of identity. Any Card found in the possession of a person other than the Member to whom it was issued, may be retained by Eurostar and that Membership may be terminated.

3.4 You must return the Card to the Eurostar™ Frequent Traveller service centre immediately when requested by Eurostar. Eurostar has the right to request the return of the Card at any time.

3.5 If Your Card is stolen You must notify the Eurostar™ Frequent Traveller service centre immediately. Please ensure that You contact the Eurostar™ Frequent Traveller service centre with a memorable detail as this may be required to check your identity and perform any further activity on your account once a Card has been reported lost or stolen.

4. General

4.1 If any benefits, facilities, Rewards or arrangements are provided or made available to You as a result of Your Membership, whether these are provided by Eurostar or by a Partner, You will be solely responsible for any and all costs, taxes, charges, claims or liabilities of any nature arising from the provision or availability of such benefits, facilities, Rewards or arrangements.

4.2 By quoting Your Membership number to Eurostar or a Partner (or an employee, franchise or agent of Eurostar or a Partner) for the first time You confirm that You agree that:

(i) You have read and understood and accept these Terms and Conditions.

(ii) You have travelled the necessary Qualifying Fare and fulfil the other criteria stated in Clause 2 for Membership.

(iii) You understand that You may be required to present Your Card or a further means of identification to Eurostar or a Partner upon request.

(iv) You consent to Eurostar creating, maintaining and updating data that is personal to You.

4.3 Your consent to these Terms and Conditions shall be deemed to continue until termination of Your Membership, howsoever it occurs. For the avoidance of doubt, Members with Inactive Membership are deemed to be still subject to these Terms and Conditions until the period of Inactive Membership expires in accordance with clause 2.8.

4.4 If You wish to terminate Your Membership, You must write to the Eurostar™ Frequent Traveller service centre confirming this and returning Your Membership Card. Within 6 weeks of receipt of Your Membership Card and Your request to terminate Your Membership, the Eurostar™ Frequent Traveller service centre will send a letter confirming that Your Membership has been terminated. Any points accumulated at that date will be cancelled.

4.5 Eurostar may, at any time, in accordance with these Terms and Conditions, revoke Your Membership or refuse or withdraw an upgrade to any Tier.

4.6 Travel on Qualifying Fares up to three months old will be accepted for joining Eurostar™ Frequent Traveller. Any Eurostar travel will only be accepted for Points once you have become a Member and You cannot claim Points for any activity undertaken before the date Your Membership commences. Once You are a Member, Eurostar accepts tickets up to 3 months after the date of travel for crediting Points for Eligible activity.

4.7 Points have a statutory cash redemption value of 0.001 pence each. You have the right to redeem Points for Rewards in accordance with these Terms and Conditions or for the statutory cash redemption value of 0.001 pence each, subject to the aggregate statutory cash redemption value being at least 25 pence.

5. Amendments to Eurostar™ Frequent Traveller

5.1 Eurostar reserves the right to change or alter any part of Eurostar™ Frequent Traveller programme including, without limitation, benefits, facilities, Partners, Rewards, arrangements, Tiers, Point collection and Reward redemption. Any such changes will normally only be made where we are required to make them through circumstances beyond our control, or in order to provide You with a better Eurostar™ Frequent Traveller, but we reserve the right to do so otherwise. Any changes will be notified to You by the method and to the address stipulated by you on joining the Eurostar™ Frequent Traveller programme. It is Your responsibility to ensure that You inform Eurostar in the event that Your details change in accordance with clause 2.5. Wherever possible, we shall try to give You reasonable notice of any changes. However, sometimes it may be necessary to make changes with immediate effect. In those cases, we will notify You as soon as possible after the changes have taken effect.

5.2 You will be deemed to have agreed to any changes to Eurostar™ Frequent Traveller made by Eurostar if, after we have sent You notice of such changes You do not terminate Your Membership as set out in Clause 4.4.

5.3 Eurostar reserves the right to cancel Eurostar™ Frequent Traveller or any part of it at any time. We shall give You six months notice of the termination of Eurostar™ Frequent Traveller during which time you may be entitled to claim Points and Rewards. On expiry of the six months period following the termination of Eurostar™ Frequent Traveller, You will not be able to claim Points or Rewards, or obtain any other benefit, service, facility or arrangement. In the unlikely event that Eurostar is required to terminate the Eurostar™ Frequent Traveller programme with immediate effect, You may not be entitled to claim Points or Rewards, or obtain any other benefit, service, facility or arrangement

5.4 Eurostar shall not be liable for any loss, costs or damages whatsoever, whether direct or indirect, arising directly or indirectly from any change to or termination of Your Membership of Eurostar™ Frequent Traveller.

5.5 Eurostar will make every effort to ensure that the benefits, facilities, Rewards or arrangements will be available*. However, Eurostar cannot guarantee that these will be available where they are to be provided by third parties or Partners. Eurostar will not be liable for any loss or damage, whether direct or indirect, arising from the provision or non-provision, termination or change, whether in whole or part, of any such services, benefits, Rewards, facilities or arrangements made available to You by a Partner or third party.

(*Eurostar cannot guarantee the right to ten minute check in and the priority taxi service is subject to availability).

6. Data

6.1 Eurostar may create, maintain and update data which is personal to You and which may include, without limitation:

(i) Membership data (for example: name, address, date of birth, employer etc);

(ii) travel data (for example: journeys taken, Points accumulated and class of travel etc);

(iii) contacts data (for example: enquiries regarding Membership etc).

6.2 The data will be maintained and updated for the purpose of providing relevant information and services to You.

6.3 You consent to data stored by Eurostar being supplied to Partners or employees or agents of Eurostar or Partners where it is necessary, in Eurostar's absolute discretion, for the running of Eurostar™ Frequent Traveller or the provision to You of any benefit or Reward. We also reserve the right to use Your address to notify You of any matters which we feel may be of interest to You.

6.4 You may contact the Eurostar™ Frequent Traveller service centre if You require further information regarding the creation, holding, maintenance and use of any data. Should You wish to update, correct or amend Your data, visit the Eurostar™ Frequent Traveller pages on www.eurostar.com or contact the Eurostar™ Frequent Traveller service centre.

6.5 Eurostar will comply with the Data Protection Act 1998 and the Data Protection Act Principles.

7. Transferability and Misuse

7.1 At no time may Points or Rewards be purchased by or sold to another person. Eurostar may terminate the Membership of any person purchasing or selling Points or Rewards immediately. Any such Points or Rewards purchased or sold will be void and You will be liable for damages, court proceedings and any related costs.

7.2 You must not lend, give, sell or otherwise provide Your Card to any person for any reason whatsoever. If Your Card is found in someone else's possession we may terminate Your Membership immediately.

7.3 Eurostar and Partners have the right to require proof of identity:

(i) whenever You present Your card in order to claim a benefit or Points;

(ii) whenever You claim or use a Reward;

(iii) at any other time in the absolute discretion of Eurostar or Partners.

7.4 Fraud or abuse of Eurostar™ Frequent Traveller may result in appropriate administrative and/or legal action by Eurostar, including the forfeiture of all accrued Points and Rewards and termination of Membership.

7.5 Please be careful with Your Card as the risk of theft or fraudulent redemption of Points passes to You as soon as Points are credited to Your Membership. Eurostar is not liable for any theft or fraudulent redemption.

7.6 Any purported purchase, sale, transfer, unauthorised use or redemption of Points issued or Rewarded or any other use of Points contrary to these Terms and Conditions will constitute a fundamental breach by the Member of these Terms and Conditions (and so of the contract between Eurostar and the Member).

8. Earning Points on Eurostar

8.1 You can earn Points whenever You travel on Eurostar.

8.2 In order to earn Points, You must give Your Membership number at the time of booking. Points will automatically be credited to Your Membership account and become redeemable for Rewards when You check-in. If You fail to do this, You may register Your Points on the Eurostar™ Frequent Traveller pages at www.eurostar.com within the 3 months following the date of travel or you can send photocopies of your tickets to the Eurostar™ Frequent Traveller service centre. Tickets received outside three months from the date of travel will not qualify for Points. You should retain Your tickets in case the correct number of Points does not appear on Your statement. You should note that Eurostar does not accept any responsibility for tickets lost, damaged or delayed in the post.

8.3 You may only accumulate one set of Points for any journey, regardless of the number of seats You have purchased. Eurostar™ Frequent Traveller membership is for individuals; therefore you may only earn points for your own travel.

8.4 Points will be awarded according to the price of the ticket purchased.

9. Earning Points with Partners

9.1 The Partners and the activities eligible for Points collection with them are available on the Eurostar™ Frequent Traveller pages at www.eurostar.com or via the Eurostar™ Frequent Traveller service centre.

9.2 You must quote Your Membership number and/or show Your Membership Card when making a booking and when checking in at a partner hotel or collecting Your car (as appropriate). The activity does not have to be undertaken in connection with a journey on Eurostar to be Eligible for Points collection. You may be asked to show an additional photo ID.

9.3 For the purposes of hotel Partners, Points will be earned on the basis of one room per Member, regardless of the number of rooms booked by You.

9.4 Certain countries in which Eurostar™ Frequent Traveller is operated may have additional local Partners. Only if You have a correspondence address in the relevant country can You earn Points through eligible activities with such local Partners.

9.5 You cannot claim Points for eligible activities with Partners unless You quote Your Membership number and/or show Your Membership Card as required in Clause 9.2.

10. Rewards

10.1 You may redeem Points for Rewards for a period up to three full years after the date at which those Points were earned provided You maintain an Active Membership and subject to the provisions of clause 5.3. After three years the Points will expire and can no longer be redeemed. If termination of either Your Membership or the whole of Eurostar™ Frequent Traveller occurs, Your Points will expire in accordance with clause 5.3 and can no longer be redeemed.

10.2 Rewards will only be issued on Your instructions and Rewards will be mailed to Your address as held by Eurostar unless otherwise notified. It is Your responsibility to ensure that, if it is required due to the nature of the Reward, the delivery can be signed for at the address given by You.

10.3 All Rewards are subject to availability. Accordingly, it may not be possible to obtain a Reward at certain times. Eurostar accepts no liability for any loss or damage caused by or during delivery.

10.4 Rewards may not be used in conjunction with any other Reward, promotion, coupon, discount or special offer and are void where and to the extent prohibited by law. Cash may not be combined with Points as part payment of Rewards unless otherwise specified by Eurostar.

10.5 Rewards are not transferable, exchangeable or redeemable for any form of cash or credit alternative, and are not refundable or exchangeable for any other Reward or benefit.

10.6 You will be subject to any Terms and Conditions of Eurostar or Partners applicable to the Reward.

10.7 You are directly responsible to Eurostar or Partners for any additional costs which are not covered by or included within the Reward.

10.8 Rewards do not include government inspection fees, departure tax, customs fees, immigration fees, airport charges, customer user fees, fuel surcharges, agricultural inspection fees or other incidental fees or taxes charged by any person or relevant authority or body. These fees will be Your responsibility. If it is required to do so, Eurostar will provide any relevant Fiscal authorities with full details of any persons in receipt of Rewards. Any liabilities that arise as a result of the submissions of these details or from a direct notification by a Member, shall be the personal liability of the Member concerned and shall not be borne or paid by Eurostar.

10.9 It is Your responsibility to ensure that You have the correct visas and travel documents as required and that they are valid for each country visited. You may be denied boarding if Your documents are not in order. Eurostar shall not be liable for any consequences arising from Your failure to have the correct documentation.

10.10The appropriate number of Points will be deducted from Your Membership at the time You confirm Your wish to receive the Reward. These points will only be re-credited to Your Membership in exceptional circumstances.

10.11The number of Points needed to redeem a Reward may differ according to the country in which Your correspondence address is situated.

10.12All Rewards may be issued at the Members request to any third party but once issued are not transferable. Only the Member may authorise the deduction of Points or issue of Rewards.

11. Reward Travel on Eurostar

11.1 You can make requests for Reward travel on the Eurostar™ Frequent Traveller pages of www.eurostar.com or by contacting the Eurostar™ Frequent Traveller service centre.

11.2 You must make any request for Reward travel at least 1 day prior to the intended travel date, except Eurostar™ carte blanche holders, who may request Eurostar travel up to 1 hour before departure when calling the Eurostar™ Frequent Traveller service centre. Please note that Rewards cannot be redeemed through the Eurostar mobile application or the through the Eurostar mobile website. All requested travel is subject to availability and excludes group bookings.

11.3 Changes are permitted once before departure for Eurostar™ carte classique holders and are unlimited for Eurostar™ carte blanche holders. Any changes will be made within the same class as the original ticket ordered. All changes are subject to availability, and once issued the tickets are non-refundable and cannot be transferred to another person.

11.4 If You are travelling on a Reward ticket You may take one child less than four years of age with You, free of charge. However, any such child will not have a seat entitlement.

11.5 Travel on a Reward ticket is not eligible for Points.

11.6 In the event of cancellation by You of the Reward ticket, You will not be re-credited with the redeemed Points.

11.7 The Eurostar International Limited Conditions of Carriage and the fare terms apply. Copies of the Conditions of Carriage are available on request from points of sale.

12. Partner Rewards

12.1 You must request a Partner Reward from the Eurostar™ Frequent Traveller service centre at least 14 days in advance, in accordance with the procedures available on the Eurostar™ Frequent Traveller pages at www.eurostar.com and through the Eurostar™ Frequent Traveller service centre.

12.2 The issue of a Partner Reward is subject to the continued participation in Eurostar™ Frequent Traveller of the Partner.

12.3 If You request a Partner Reward which requires a Reward certificate, the relevant Points will be deducted from Your Membership at the time the certificate is dispatched. In the event that the certificate is lost or stolen, Eurostar will not reinstate the Points or reissue the certificate.

12.4 Reward activity with any Partner is not eligible for earning Points, unless otherwise specified.

12.5 You can only redeem a limited number of shopping vouchers per year. Please see www.eurostar.com for further details.

13. Tiering

13.1 The Points required to achieve and/or maintain Active Eurostar™ carte classique status or Eurostar™ carte blanche status are set out in the Member Guide or on the Eurostar™ Frequent Traveller pages at www.eurostar.com. Only Points earned for Eurostar travel within the relevant year from the date of enrolment or achieving that Tier status will be counted towards achieving or maintaining Active Eurostar™ carte classique status or Eurostar™ carte blanche status.

13.2 The number of Points required for achieving or maintaining Active Eurostar™ carte classique status or Eurostar™ carte blanche status is subject to change by Eurostar. We will normally give You reasonable notice of any such change, but reserve the right to do so otherwise in exceptional circumstances.

13.3 Access to Eurostar Business Premier lounges is only available to Eurostar™ carte blanche holders in conjunction with a departure on a Eurostar journey subject to availability (in the event of capacity being reached).

13.4 When You have earned sufficient Points to gain an upgrade to a higher Tier, You will be automatically sent an upgrade pack. Your Membership number will remain the same.

13.5 Upgraded status is valid for one year from the date of the upgrade to the higher Tier. If You do not earn sufficient Points to maintain your status in the year following the upgrade, Your status will be downgraded at end of this period.

13.6 Eurostar™ carte classique holders, who do not make at least one journey on Eurostar in a membership year, will be deemed to have Inactive Membership. You will have one year to redeem any remaining points before they expire as detailed in Clause 2.8.

14. Limitations on Eurostar's Liability

14.1 Limitations on Eurostar's liability appear in particular at clauses 5.4, 5.5, 10.8, 10.9 and 15.1 and as set out below.

14.2 Eurostar shall not be liable for any loss, delay, damage or injury which occurs in connection with the use or redemption of any Reward provided by a Partner under Eurostar™ Frequent Traveller. Any responsibility for any such loss, delay, damage or injury shall be solely that of the Partner or third party providing such a Reward. Eurostar does not seek to exclude liability for death or personal injury caused by its negligence.

14.3 Eurostar's sole liability in relation to Eurostar™ Frequent Traveller whether for negligence, breach of contract or any other matter shall be limited to re-crediting to Your Membership Points equal to those redeemed for the Reward in connection with which such matter arose.

14.4 Eurostar has no liability for the acts or omissions of Partners or third parties.

14.5 While every effort has been made to ensure all the information in the Member Guide or on the website is correct, Eurostar is not responsible for any errors, whether printing or typographic errors or otherwise, or any consequences thereof.

15. Miscellaneous

15.1 If, by reason of a local law or regulatory prohibition or restriction, Eurostar is unable to make Eurostar™ Frequent Traveller or any part thereof available in certain countries or to certain individuals Eurostar will not be liable for any such unavailability.

15.2 In the case of duplication of Membership, all Membership and all duplicated Points will be merged.

15.3 Notices sent to You shall be deemed to have been received by You if posted to Your address as held by Eurostar. Notices from You to Eurostar should be sent to the Eurostar™ Frequent Traveller service centre.

15.4 Eurostar will not be responsible for late, lost or mis-directed mail.

15.5 In the event of Your death, Your Membership will be terminated automatically and all accumulated Points and unused Rewards will be cancelled.

15.6 Eurostar monitors and records telephone calls to the Eurostar™ Frequent Traveller service centre for training or in order to enhance the service provided to You. Calls charged at relevant national rates.

15.7 Any changes to the Terms and Conditions that have been made so as to comply with local laws and regulations shall prevail.

15.8 If at any time one or more of these Terms and Conditions becomes invalid, illegal or unenforceable in respect of any applicable law, the validity, legality and enforceability of the remaining Terms and Conditions shall not be in any way affected or impaired thereby.

15.9 These Terms and Conditions do not constitute or create a members or proprietary club.

15.10 If Your correspondence address as held by Eurostar is inFranceorBelgium, these Terms and Conditions are governed by the law of the country in which Your correspondence address is situated. In the event of any dispute between You and Eurostar, You agree to submit to the exclusive jurisdiction of the courts of that country. If Your correspondence address as held by Eurostar is in theUnited Kingdom, these Terms and Conditions are governed by English law and in the event of any dispute between You and Eurostar, You agree to submit to the exclusive jurisdiction of the English courts.

15.11 These Terms and Conditions are correct at the date of publication.
